Under no circumstances will the Buyer (or its advisors) be liable for any costs or expenses incurred by suppliers, funders and/or its respective advisors arising directly or indirectly from the procurement process or termination thereof, including, without limitation, any changes or adjustments made to the tender documentation, or the exclusion/disqualification of a supplier.
Suppliers are entirely responsible for the costs of participating in this procurement and no payment, reimbursement, compensation, or any other remuneration will be payable by Buyer to unsuccessful suppliers. All costs, expenses and liabilities incurred by the suppliers in connection with the preparation and submission of the Tender will be borne by the suppliers. For the avoidance of doubt this includes without limitation costs and fees incurred by suppliers in instructing lawyers, accountants and other advisers, the costs of any sub-contractors and (if applicable) the participation in any negotiations and presentations.
Accordingly, the Buyer accepts no liability to pay for any quote or other preparatory work undertaken in connection with this CfT or any other communication between the Buyer and any other party and the suppliers have no claim whatsoever against the Buyer in respect of such costs. Suppliers must obtain for themselves at their own expense all information necessary for the preparation of their Tenders.
